On December 19, 2007, two former employees of Antelope Valley Newspapers initiated a Class Action lawsuit on behalf of all Non-exempt, hourly employees of Antelope Valley Newspapers from December 19, 2003 to the Present for wage and hour violations. A class and a subclass were certified and defined as:
All current and former California-based, hourly, non-exempt employees of Defendant ANTELOPE VALLEY NEWSPAPERS, INC. who were employed by ANTELOPE VALLEY NEWSPAPERS, INC. between December 19, 2003 and the present (hereinafter, "the CLASS").
All former California-based, hourly, non-exempt employees of Defendant ANTELOPE VALLEY NEWSPAPERS, INC. who separated their employment with ANTELOPE VALLEY NEWSPAPERS, INC. between December 19, 2003 and the present (hereinafter, "the SUBCLASS.").
The Class Action complaint seeks monetary damages for:
- Requiring employees to work beyond 8 hours a day or 40 hours a week, and failing to compensate for overtime;
- Failing to provide 30-minute meal breaks within the first 5 hours of work shift and failure to provide a second 30-minute meal break for work shifts over 10 hours;
- Failing to provide 10-minute rest periods;
- Failing to provide properly itemized wage statements;
- Failing to pay full compensation due at time of employment termination or separation; and
- Unlawful and unfair business practices.
