Illegal Charges for Emergency Care

Have You Received a Bill for a Visit to the Emergency Room?

Patients with Insurance cannot be Required to Pay for Emergency Care in California

California Class Action Firm, Emge and Associates, is investigating allegations that insured patients have been illegally charged for Emergency Room Medical Care. The California Supreme Court recently clarified the rule that insured patients may not be billed for emergency medical care. The Court stated that this practice known as “balance billing” is an unfair business practice, and that any dispute regarding emergency care services must be “resolved solely” between hospitals or doctors and a patient’s insurance company.

What does this mean for consumers? A hospital or physician group may not bill or contact you about bills arising from emergency medical services. They may not threaten you with debt collection and/or ruining your credit. Any contact about your bill is prohibited.

To determine if you have been damaged, look at the following factors:

  • Have you visited an emergency room for treatment in the last 4 years?
  • Did your insurance company cover 100% of the emergency care bills and related services?
  • If not, did you pay any of the bills for emergency care?

If you believe you are a victim of balance billing, please contact Emge & Associates at (619) 595-1400 immediately to discuss your legal rights.
