What is this class action about?
- The lawsuit was filed as a class action in San Diego Superior Court on behalf of all hourly employees of Premier Food Services, Inc.
- The lawsuit seeks compensation for each day an employee did not receive a full 30-minute, uninterrupted meal period within the first 5 hours of the work shift or a second 30-minute uninterrupted meal period for shifts in excess of 10 hours.
- The lawsuit also seeks compensation for each day an employee did not receive state mandated rest breaks of 10 minutes during shifts of 4 hours or longer.
- California law provides that employees who are denied their meal periods or rest breaks are entitled to one additional hour of pay for each day where a violation occurred.
- The goal of this lawsuit is to put an end to the violations of California law and obtain back wages and penalties on behalf of all hourly employees.
