On October 24, 2013, a non-exempt, hourly employee of Frazee Industries, Inc. initiated a Class Action against his employer on behalf of all hourly workers employed in California for wage and hour violations. Plaintiff contends that he was not provided with timely meal periods.

Specifically, hourly employees faced a busy morning schedule due to customers buying supplies predominately in the morning. Due to staffing and management decisions, employees were not allowed to take meal breaks during these busy times, often resulting in a failure to provide a timely meal period.

Under California law, an employer is required to compensate its employees with an extra hour of wages for every day that it failed to provide a timely meal period. Plaintiff seeks restitution of these unpaid wages on his own behalf as well as on behalf of all other similarly situated employees in California.
